But it is the wrong prescription.

Let's break down the actual numbers. TRUMP launched on Solana days before the inauguration. It spiked to over $70 within hours, minting a top-20 asset and the second-largest meme coin by market cap. Eighteen months later, it trades under $1.50. That's a 98% drawdown. It is no longer in the top 100 by market cap. The token's terminal value is close to zero.

The senators' letter to SEC Chair Paul Atkins cites reports that nearly a million investors lost over $3.8 billion between January 2025 and June 2026. During that same window, the POTUS family or affiliated entities reportedly earned around $636 million through trading fees and other revenue streams. The letter argues this asymmetry warrants a formal investigation into the project's structure and marketing. It also references allegations that some traders profited before the public could react. That is a classic insider front-run.

But this token is a product where the principals' efforts are aimed at monetizing the attention of the participants, not generating profit for them. From a structural standpoint, it's not a security. In other words, the letter could trigger a short-term "regulation pump" that allows more insiders to exit. This is not a conspiracy theory; it is a consequence of attention-driven order flow.

There is another angle worth considering: state regulators like New York's have already warned about pump-and-dump dynamics in meme coins. The SEC has precedent in enforcement against similar schemes. Yet the outcome of a probe is irrelevant to the recoverability of $3.8 billion. Crypto losses are not returned because a letter is written. They are returned only if the issuer holds recoverable assets and the jurisdiction is cooperative. Most meme coin treasuries have already been distributed. The money is gone. Senator Warren knows this. Senator Blumenthal knows this. The letter is political signaling, not investor protection.

The next meme coin will have a friendlier name, a larger launch, and the same fee-based distribution trap. The SEC may or may not bring a case.
